In a heated court filing on Wednesday, DOJ prosecutors made an audacious claim: accepting a pardon from President Trump would amount to a “confession of guilt.” The filing, part of the sentencing case for J6 defendant Dova Winegeart, was clear in its intent to discredit any future presidential clemency.

The DOJ’s filing reads, “[A] pardon at some unspecified date in the future…would not unring the bell of conviction. In fact, quite the opposite. The defendant would first have to accept the pardon, which necessitates a confession of guilt.”

Winegeart, convicted in October of damaging government property, is seeking a delay in her four-month prison sentence in anticipation of a potential Trump pardon. The DOJ’s stance aims to thwart not just her efforts but to send a clear message to all 1,600 defendants tied to the January 6 Capitol protest: any clemency will be a mark of shame, not justice.

A Political Double Standard

This saber-rattling from the DOJ stands in sharp contrast to its treatment of Hunter Biden. Earlier this month, President Joe Biden issued a sweeping pardon to his son, shielding him from prosecution for any crimes over the last 11 years. The DOJ raised no concerns about whether this blanket pardon carried an “admission of guilt.” Quite the opposite: Joe Biden justified the move by accusing his own DOJ of acting “selectively” and “unfairly” in prosecuting Hunter.

Meanwhile, reports suggest Biden is considering preemptive pardons for key Democratic allies, including Senator-elect Adam Schiff and former NIAID Director Anthony Fauci. These pardons, meant to insulate them from any investigations under a Trump DOJ, have drawn sharp criticism for blatantly politicizing the process.

Trump’s Response

President Trump has already signaled his intention to issue swift pardons for January 6 prisoners, describing the prosecutions as politically motivated and calling for accountability for those behind the investigations. Speaking Sunday, he promised his administration would “act very quickly” to grant clemency and floated the idea of criminal consequences for members of the House January 6 committee.

The DOJ’s characterization of Trump’s plans as “purely speculative” is laughable given his repeated public statements and unwavering campaign promises.
